In all cases, this is a fairly low concentration of CBD per gummy, but taking two or three isn’t the end of the world when the price is competitive (more on that below). The total amount of non-CBD cannabinoids is very similar in both cases (around 0.35mg). According to the certificate of analysis for our Cherry Mango gummies, there were 11.73mg of CBD per gummy and a total of 0.49mg of CBDV (cannabidivarin), CBG (cannabigerol), CBN (cannabinol), delta-9 THC (tetrahydrocannabinol), and CBD (cannabichromene) per gummy. These Extra Strength Gummies are infused with PlusCBD Oil’s Gold Formula, which is the first-ever self-affirmed Generally Recognized as Safe full-spectrum hemp extract. As mentioned, the use of L-theanine, magnolia extract, melatonin, and other enhancers in the newly added Calm and Sleep gummies brings another layer of quality and effectiveness to these formulations. Also, we see natural coloring and organic sugar, and the sugar content is two milligrams per gummy, which is reasonable. Overall, these ingredient lists are very impressive, making up for the slightly underwhelming non-CBD cannabinoid content. TasteThe Calm gummies come in strawberry lemonade, and the Sleep gummies come in raspberry. As we hoped, you can actually taste the strawberry and raspberry, and real cane sugar is always better than high-fructose corn syrup. The Calm gummies were more effective at covering up the bitter hemp flavor, but both products were very tasty. As for the Extra Strength flavors, we preferred the Cherry Mango over the Citrus Punch, but for purely subjective reasons; they were both also very tasty and equally adept at covering up the hemp taste. EffectivenessStarting with the Extra Strength first, taking one gummy at a time did not produce noticeable results in any of the areas we were measuring, including pain/discomfort, relaxation, and sleep. However, taking two or three gummies at a time did make a difference in mood regulation as well as sleep quality. We were able to fall asleep faster and stay asleep longer after taking at least two gummies in the evening. Taking PlusCBD Oil Gummies in the morning also helped us to remain calm and focused throughout the day. The results weren’t as striking in the area of pain and discomfort, but that may be because we’re not dealing with post-operative pain, chronic pain disorders, and other problems that many CBD takers have to contend with. PlusCBD Sleep and Calm Gummies EffectivenessSleep formulations tend to be hit or miss in the CBD world—at least in our experience—but the PlusCBD™ Oil Sleep gummies were definitely effective. TESTSTSARDSARIreland to See ‘Steppingstone’ Cannabis Reform Measure Introduced by Hazel Norman A bill that would legalize the personal use of cannabis in Ireland was expected to be introduced last summer, however, that did not happen. People Before Profit TD Gino Kenny, who has long advocated for cannabis public policy reform in Ireland, is expected to finally introduce the measure in the coming days. The Misuse of Drugs Acts is currently the binding law in Ireland, and it provides for a fine of €1,000 in the District Courts for first and second offenses involving personal cannabis possession. Larger fines can be handed down in some instances. If someone commits the offense of personal possession and it’s their third or greater offense of its type, the offender can be sentenced to up to one year in prison, although, the Criminal Justice Act in Ireland mandates that courts must consider giving a community service penalty in place of a prison sentence, and that affects some cases. The new measure is expected to be formally introduced next week, and is expected to largely be based on the principal of allowing people to consume cannabis in private and possess up to seven grams of cannabis flower. It’s good news to hear that the legislation will be seen as a ‘steppingstone’ versus a ‘final solution.’ Being able to possess up to seven grams of cannabis without fear of prosecution is a great thing to be sure. However, until there are regulated sales permitted in Ireland, gangs and cartels will continue to control profits. The chances of the limited bill passing is unclear at this time. Fortunately, cannabis reform is on the move at an ever-increasing pace outside of Ireland, including and especially in Europe. That will put pressure on lawmakers within Ireland. Essentially, cannabis pilot programs provide for limited adult-use cannabis commerce in a designated area and research from the pilot programs provide insight to lawmakers for if/when they craft national cannabis laws and regulations. A cannabis pilot program already exists in Copenhagen, Denmark and lawmakers there are trying to expand pilot programs to other cities in the European country. All cannabis for Copenhagen’s pilot program is domestically produced. Two other European countries previously announced plans to launch their own pilot programs, the Netherlands and Switzerland, although both countries have experienced setbacks. For the pilot program in Basel, Switzerland specifically, domestic cannabis failing to meet stringent pesticide requirements has resulted in the program looking elsewhere to source its cannabis, particularly in Canada. How cannabis is sourced for adult-use commerce is tricky, which is being demonstrated by the ongoing effort in Germany to legalize adult-use cannabis sales. Germany is reportedly going to source all of the cannabis for its eventual adult-use market domestically. Apparently lawmakers and regulators seem to feel that while cannabis can be imported and exported for research and medical use, it cannot be imported for adult-use sales. What is being proposed in Basel is somewhat interesting, in that someone could make a strong argument that the cannabis is indeed for research purposes, albeit to research whether adult-use sales can be properly regulated at a local level prior to being regulated at a national level. To conduct the feeding experiment, the German Federal Institute for Risk Assessment (BfR) researchers divided ten lactating Holstein Friesian dairy cows into two groups—those that received low-hemp feed and high-hemp feed—before administering each cow its feed over a quadriphasic trial period: control (7 days of hemp-free feed for all), adaptation (7 days), exposure (6 days), and depuration (8 days). The researchers used liquid chromatography-tandem mass spectrometry and toxicokinetic computer modeling to accurately assess the “feed-to-milk transfer rate” of cannabinoids they were measuring – determining a rate of 0.20% +/- 0.03%. As for the effect of the hemp feed on the cows themselves, the researchers noted that “Feeding up to 0.92 kg per cow per day of industrial hemp silage A with very low cannabinoid concentration … had no effect on physiological parameters and health.” However, the cows given cannabinoid-rich feed reportedly demonstrated the following effects:
For those not in the know, this study is of particular importance to American dairy farmers, some of whom are calling for more exploration of hemp feed for cattle because of its affordability and nutritional value. Hemp-based cattle feed remains outlawed in the US for now out of concerns for cannabinoids proliferating into the food supply. A separate study from France also found that cannabis is inversely associated with obesity among HCV patients. It is estimated that as many as 58 million people suffer from hepatitis C worldwide. The World Health Organization estimates that roughly 1.1 million deaths occurred in 2019 due to hepatitis B and C, and their effects include ‘liver cancer, cirrhosis, and other conditions caused by chronic viral hepatitis.’ Hepatitis C is spread by contact with contaminated blood, such as from sharing needles or from people using unsterile tattoo equipment. Yet another study in France examined cannabis and HCV, and the results of this latest study indicate that cannabis use is inversely associated with hypertension in HCV patients. Below is more information about it via a news release from NORML: Marseille, France: HCV (Hepatitis C virus)-infected patients who consume cannabis are less likely than non-users to suffer from either hypertension or other metabolic disorders, according to data published in the Journal of Clinical Medicine. French researchers assessed the relationship between current and/or lifetime cannabis use and metabolic disorders in a cohort of 6,364 subjects infected with HCV. Investigators reported, “Former and current cannabis use were both inversely associated with hypertension in both analyses (adjusted odds ratio [aOR]: 0.74 and 0.45).” They also possessed fewer metabolic disorders (e.g., obesity, diabetes, etc.) than did those with no history of cannabis consumption. They concluded: “In a large cohort of people with chronic HCV infection living in France, current or former cannabis use was associated with a lower risk of hypertension and a lower number of metabolic disorders … Future research should also explore the biological mechanisms underlying these potential benefits of cannabis use, and test whether they translate into reduced mortality in this population.” Prior studies have identified an association between cannabis use and lower rates of diabetes and fatty liver disease in Hep-C infected subjects. Bush signed the Americans with Disabilities Act (ADA) in 1990, a new era of civil rights for the disabled was born. New buildings were required to be handicap accessible and discrimination against the disabled was banned. And as of 2021, it also means websites must be ADA-compliant. But not all websites are bound by the ADA, only those considered a ‘place of public accommodation,’ according to the U.S. Department of Justice (DOJ). Cannabis e-commerce sites fall into this category and retailers could face stiff penalties if found non-compliant. What is a Place of Public Accommodation?On March 18, the DOJ issued updated promulgations on website accessibility based on the ADA. The ADA’s requirements apply to all goods, services, privileges, or other activities offered by public accommodations, including those offered on the web,” the DOJ stated in the guidelines.” According to Indianapolis attorney Brett J. Ashton, many courts across the U.S. did not wait for the DOJ to issue its March 2022 guidelines to determine what constitutes a public accommodation. Some ruled an actual storefront is required for a business and its website to be defined as a public accommodation. Others continue to grapple with the nexus between a business’s physical space and its website. Meanwhile, the DOJ has issued comments which seem to indicate its hesitancy to shield commercial websites sans a brick-and-mortar location from discrimination liabilities. In other words, not having a physical location does not mean a commercial website need not meet ADA standards. “If a business sells a product on its website, it’s a public accommodation, so the ADA applies,” said Attorney Jeff Lantz, CEO of Esquire Interactive, LLC, a social media and content creation venture. An ADA PrimerThe ADA is a civil rights law prohibiting all forms of discrimination against the disabled. It is divided into five sections, called Titles. Each Title prohibits discrimination against the disabled in different aspects of their lives. The Titles and their areas of focus are: Title I: Employment Title II: State and Local Government Title III: Public Accommodations and Commercial Facilities Title IV: Telecommunications Title V: Miscellaneous Provisions Title III states “no individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of any place of public accommodation.” Furthermore, the Title prohibits any person owning, leasing, or renting a public accommodation to a third party from discriminating against the disabled. When the ADA was enacted, it failed to clearly state the guidelines for handicap accessibility. The DOJ published the 2010 ADA Standards for Accessible Design to correct that. The standards led to revisions of Titles II and III, which went into effect in 2012. Seeking additional clarification, 181 businesses petitioned the DOJ for guidelines delineating how to make websites ADA-accessible in February 2022. The DOJ responded by publishing new guidelines on website accessibility on March 18, 2022. Still, bemoans Lantz, those promulgations don’t go far enough. One thing that was made clear is that businesses must “follow all laws and regulations, including the ADA,” he said. He lamented, however, “It is nebulous what it means to be ADA-compliant due to recent case [law] results and vague DOJ guidelines.” How to Know if Your Website is a ‘Go’Fortunately, there are ways to analyze whether a commercial website is ADA-accessible. An excellent place to start is the Web Accessibility Initiative. The initiative, supported by the World Wide Web Consortium (W3C), develops standards and support materials designed to assist people in making websites more accessible. Also imperative is a perusal of the Web Content Accessibility Guidelines (WCAG). These technical promulgations, published by the Web Accessibility Initiative, detail how to make websites ADA-compliant. The WCAG pertains to websites, phone apps, and other digital content. The three levels of ADA-website compliance are: A: Minimal compliance AA: Includes all Level A and Level AA requirements. Most companies aim for compliance on this level AAA: Includes all Level A, AA, and AA requirements and is the strictest level of conformity. Few businesses strive to meet this standard Level A conformance does not generally offer broad accessibility while Level AA offers a mid-range level. The most notable Level AA requirements include: 1. Captions (for live audio and video) 2. Consistent navigation elements site-wide 3. Color contrast, at least 4.5:1 4. The ability for status updates to be conveyed through a screen reader Several free websites diagnose website accessibility, usually for free. A quick search of the web will reveal numerous options. Why ADA Compliance MattersThere are several reasons why a cannabis entity’s website should be ADA-compatible. For starters, it’s the law. Beyond that, an accessible website is a “good policy that is consumer-focused. Individuals eligible for medical marijuana will have underlying medical conditions. “So, even without the law, it’s a best practice to modify a website to accommodate patients with various medical and physical issues,” said Columbus lawyer Chad Blackham. Blackham also noted that in our post-pandemic world, where remote working is a growing trend, adapting a website so it can be used by anyone is “an adaptation to post-COVID life.” According to David M. Benson, a bankruptcy attorney in Cleveland, since cannabis is still illegal federally, a marijuana company racking up sizable legal fees defending ADA-website litigation is barred from filing bankruptcy. “I can’t help you,” he said. Cannabis entrepreneurs are especially vulnerable to ADA-website compliance complaints because they already face a complicated web of state and federal promulgations, opined Blackham. Ashton noted an uptick in ADA-website compliance cases filed over the past few years. “Three years ago, I might have told a client to ignore those letters (complaining about website compliance) but now, we respond to the demand letter. In the past few months, more complaints have been filed.” “There’s a large incentive for Plaintiffs to pursue these cases, and 99% settle” Blackham added. Most lawsuits alleging a failure to meet ADA-website compliance laws seek less than $100,000 in damages to keep the case out of Federal Court. Ashton also said he often counsels insurance companies to settle rather than litigate because “the legal fees are not worth the money.
